POOLS
DEFINITION:
- Permanent Swimming Pool - An in ground or above ground pool that is not designed to be taken down each fall, which has a depth of more than 24 inches covering more than 25 square feet or that has a capacity of more than 200 gallons of water.
- Temporary Swimming Pool - An artificially created pool or tank above grade, or partially below grade, which has a depth of more than 24 inches covering more than 25 square feet or that has a capacity of more than 200 gallons of water, created for the purpose of swimming, wading or water recreation, that will be taken down in the fall of the year and erected at the beginning of the next warm season.
- Hot Tub - A large tub of hot water in which bathers soak and usually socialize especially such a tub with a whirlpool device which has a depth of more than 24 inches covering more than 25 square feet or that has a capacity of more than 200 gallons of water.
REGULATIONS:

Pools cannot be located in an easement.

Pools must be at least 2' from a side yard line and 5' from a rear yard line.
- Pools must be enclosed by a fence.
- If wrapping a deck around an above ground pool there cannot be any other access to the pool other through a gate that meets the requirements below.
- Fences for pools must be at least 42" high.
- Fence gate(s) shall be of a self-closing and self-latching type capable of keeping such gate securely closed at all times. The gate must positively close and latch when released from an open position of six (6) inches from the gate post.
- Exemption - Above-ground pools with a wall height of 42 inches above grade or greater shall be exempt from fencing requirements.
- Any ladder used to access an above ground pool which is exempt from fencing requirements, must be removed or secured to prohibit access to the pool when the pool is not in use.
- Natural topography. Natural topography that prevents direct access to the pool or spa area shall include but not be limited to cliffs and natural rock formations. A natural barrier approved by Mahomet Building Inspector shall be acceptable provided that the degree of protection is not less than the protection afforded by a fence.
- The Water and Sewer Department.
- Does allow pool filling from a hydrant, however, there are multiple variables involved. Please contact the Village to determine eligibility. Regardless, you must fill out a form and use a meter provided by the department.
- No pools can be emptied into a sanitary sewer line.
MAINTENANCE:
- No pool shall be allowed to:
- Contain stagnant water.
- Be infested with mosquitos vermin or other pests.
- All pools shall be keep in a sanitary condition.
- Pools cannot be emptied in a manner which will permit significant water flow onto property owned by another person without the advanced written consent of all effected property owners.
PROPERTY OWNER and/or CONTRACTOR RESPONSIBILITIES:
- Zoning requirements. All applicable zoning requirements must be met
- Building code requirements. All residential pool construction should conform to the 2015 International Residential Code Chapter 42 and adopted amendments.
- HOA / POA approval. If the subject property has subdivision covenants that require Architectural Review Committee approval, please obtain approval as needed or required per the subdivision requirements
- Fee. All fees must be paid in full at the time of application; nonpayment or incomplete information will delay application review. Failure to obtain a permit will result in a double charge fee.
- Permit expiration. All work must be completed within 6 months from the permit approval date. Any incurred fines must be paid before the occupancy inspection.
- Violations. Properties found to have violations could result in delay in application review, approval, or permit issuance.
SITE PLANS:
- Must include the following:
- Layout of proposed project.
- Distances to:
- Property lines.
- Other structures on the property
- If it is inground or above ground.
- Temporary pools that you will be taking down in the off season.
- How many gallons the pool holds.
